Volunteer Terms and Consent

Draft. Final waiver needed from Leathers.This is not in effect. It is adapted for Jenks from a waiver used on another Leathers community build. The final wording must come from Leathers & Associates and be reviewed by the School District of Philadelphia and legal counsel.

This is a release of legal rights. Read all of it before you accept, and ask a committee member about anything you don't understand. Your acceptance takes effect right away.

Safety

The J.S. Jenks Academy playground build is a construction site, and it can be dangerous. Don't use a tool or take on a task unless you are fully comfortable with it. Take care not to put yourself or anyone else at risk. If you see something unsafe, tell a crew captain or committee member right away.

If a child works with you, keep them close at all times. Their safety is your responsibility.

Who this release covers

In these terms, the "Released Parties" are the School District of Philadelphia, J.S. Jenks Academy, Friends of the Children's Park in Chestnut Hill, Leathers & Associates, the sponsors of the volunteer program, and each of their officers, directors, board members, employees, volunteers, agents and independent contractors, along with other participants in the build.

1. Release, indemnity and hold harmless

For myself, any minor child I sign up, and our heirs, assigns and legal representatives, I agree to indemnify, defend and hold harmless the Released Parties from all claims of any kind for personal or bodily injury or illness, including death, that happen during the volunteer build or are made worse by it.

I also give up any claim that I or my minor child may have now or later against the Released Parties for negligence, or for anything else that arises from taking part in the build. This release is meant to be as broad as Pennsylvania law allows. If part of it is held invalid, the rest stays in effect.

2. Assumption of risk

For myself and any minor child, I accept all risk of injury, illness, death or property damage from the volunteer build. I understand that the work is strenuous and dangerous, that not everything can be predicted, and that it should only be done by people in good health.

3. Medical release

For myself and any minor child, I release the Released Parties from any claim arising from first aid, treatment or other help given for an injury connected to the build. I take full responsibility for my own welfare and safety and my minor child's during the build. I give permission for emergency medical treatment as needed.

4. Photographs and recordings

I consent to being photographed or recorded during the build, along with my minor child. I allow the School District of Philadelphia and Friends of the Children's Park to use those images and recordings at their discretion.

Your acceptance

By checking the box at sign-up, I confirm that I have read these terms and understand that I give up substantial rights for myself and my minor child. I accept them voluntarily, knowing the risks and conditions. I confirm that I am at least 18, or that my parent or guardian has given the consent below.

Parents and guardians of volunteers under 18

I am the parent or legal guardian of this participant, and I accept all of the terms above on their behalf. For myself, my heirs, assigns and next of kin, I release, indemnify and hold harmless the Released Parties from all liability connected to my minor child's participation, even if it arises from their negligence, to the fullest extent the law allows. I have told my child about these warnings and conditions.
